1. Acceptance of Terms

Welcome to Haniti Po ("I Parked Here"). These Terms of Service ("Terms") govern your use of the Haniti Po mobile application (the "App" or "Service"). By accessing or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the App.

2. Description of Service

Haniti Po is a community-driven mobile application that allows users to:

• Discover and share parking spot locations
• View photos and information about parking spots
• Contribute parking spot data to help other users
• Earn points and achievements through participation
• Review and report issues with parking spots

The Service is provided free of charge and relies on user-generated content to build a collaborative parking database.

3. User Accounts and Registration

3.1 Account Creation

• You must create an account to use certain features of the App
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 13 years old to create an account

3.2 Account Security

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

4. User Conduct and Prohibited Uses

When using Haniti Po, you agree NOT to:

4.1 Prohibited Content

• Submit false, misleading, or inaccurate parking spot information
• Upload inappropriate, offensive, or illegal photos or content
• Impersonate any person or entity
• Violate any applicable laws or regulations

4.2 Prohibited Activities

• Create fake parking spots or spam submissions
• Manipulate the gamification system or artificially inflate your points/level
• Harass, threaten, or abuse other users
• Attempt to gain unauthorized access to the App or other users' accounts
• Use automated tools (bots, scripts) to interact with the Service
• Reverse engineer, decompile, or attempt to extract the source code of the App

4.3 Intellectual Property Violations

• Upload content that infringes on others' copyrights, trademarks, or intellectual property rights
• Use the App's content, data, or materials without permission

5. User-Generated Content

5.1 Content Ownership

• You retain ownership of any content you submit to the App (photos, descriptions, reviews)
• By submitting content, you grant Haniti Po a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the App

5.2 Content Standards

All user-generated content must:

• Be accurate and truthful to the best of your knowledge
• Not contain offensive, discriminatory, or hateful material
• Not violate any third party's rights
• Comply with applicable laws and regulations

5.3 Content Moderation

• We reserve the right to review, edit, or remove any user-generated content
• We will review and respond to reported content within 72 hours (3 business days)
• Content that violates these Terms may be removed without notice
• Repeated violations may result in account suspension or termination
• We are not responsible for user-generated content and do not endorse any opinions expressed by users

5.4 Content Removal

• You may delete your pending parking spot submissions at any time through the App
• Once a submission is approved and published, removal may require contacting support
• We will respond to valid legal requests for content removal

6. Gamification Features

6.1 Points, Levels, and Badges

• The App includes gamification features such as points, levels, badges, and streaks
• These features are for entertainment and engagement purposes only
• Points and achievements have no monetary value and cannot be exchanged for goods or services

6.2 Fair Play

• You must not manipulate or exploit the gamification system
• We reserve the right to adjust or remove points, levels, or badges obtained through violations of these Terms
• We may modify the gamification mechanics at any time

7. Location Data and Privacy

• The App collects and uses location data as described in our Privacy Policy
• You can control location permissions through your device settings
• Parking spot locations are visible to all App users

8. Third-Party Services

The App integrates with third-party services including:

• Google Maps API for map display and navigation
• Firebase for authentication and data storage
• Google Analytics for usage analytics (if enabled)

These third-party services have their own terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

9. Intellectual Property Rights

9.1 App Ownership

• The Haniti Po App, including its design, features, code, and branding, is owned by Haniti Po Team
• All trademarks, service marks, and logos are the property of their respective owners
• You may not use our intellectual property without express written permission

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal devices
• Use the App for personal, non-commercial purposes
• Access and view content within the App

This license automatically terminates if you violate these Terms.

10. Disclaimers and Limitations of Liability

10.1 "As-Is" Service

• The App will be error-free or uninterrupted
• Parking spot information is accurate, current, or complete
• The App will meet your specific requirements
• Any defects will be corrected

10.2 User-Generated Content Disclaimer

10.3 Limitation of Liability

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or use
• Parking tickets, fines, or towing costs
• Unauthorized access to or alteration of your data
• Damages arising from use or inability to use the App

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE APP (WHICH IS ZERO FOR FREE USERS).

10.4 Parking Compliance

11. Indemnification

You agree to indemnify, defend, and hold harmless Haniti Po Team and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your user-generated content

12. Account Termination

12.1 Termination by You

• You may stop using the App at any time
• You can delete your account through the User Profile settings in the app, or by contacting hanitipo.requests@gmail.com

12.2 Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account remains inactive for an extended period
• We discontinue the Service

12.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• We may delete your account data in accordance with our Privacy Policy
• Sections of these Terms that should survive termination will remain in effect

13. Modifications to the Service and Terms

13.1 Service Changes

• We reserve the right to modify, suspend, or discontinue the App at any time
• We may add, remove, or modify features without notice
• We are not liable for any modification or discontinuation of the Service

13.2 Terms Updates

• We may update these Terms from time to time
• Significant changes will be communicated through the App or via email
• Continued use of the App after changes constitutes acceptance of the updated Terms
• The "Last Updated" date at the top indicates when Terms were last modified

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms are governed by the laws of the State of Israel, without regard to its conflict of law provisions.

14.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Israel.

14.3 Informal Resolution

Before filing a formal claim, please contact us at hanitipo.requests@gmail.com to attempt to resolve the issue informally.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Haniti Po regarding the App.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

15.5 Language

These Terms are provided in both English and Hebrew. In case of any conflict between the English and Hebrew versions, the English version shall prevail.
